Cannabidiol (CBD) wird nach europ\u00e4ischem Recht nicht als „Rauschgift“ angesehen<\/strong><\/h1>\n

Ein Mitgliedstaat darf das Inverkehrbringen von Cannabidiol (CBD), das in einem anderen Mitgliedstaat rechtm\u00e4\u00dfig hergestellt wurde, nicht verbieten, wenn es aus der Cannabis sativa-Pflanze in ihrer Gesamtheit und nicht nur aus ihren Fasern und Samen gewonnen wird.<\/strong><\/h4>\n

Im November 2020 ver\u00f6ffentlichte der Europ\u00e4ische Gerichtshof ein Urteil, in dem er feststellte, dass das aus der Cannabispflanze gewonnene Cannabidiol nicht als Droge im Sinne des Einheits\u00fcbereinkommens der Vereinten Nationen \u00fcber Suchtstoffe von 1961 anzusehen ist.<\/p>\n

Das UN-\u00dcbereinkommen von 1961 ist die Grundlage f\u00fcr nationale Drogenkontrollgesetze, die Cannabis kontrollieren. Darin hei\u00dft es, dass der unerlaubte Verkauf von „Cannabisbl\u00fcten“ und „Cannabisextrakten und -tinkturen“ strafrechtlich geahndet werden sollte. Dies wurde sp\u00e4ter in den Rahmenbeschluss 2004\/757 des Rates \u00fcber Sanktionen f\u00fcr den Drogenhandel aufgenommen. Diese Bl\u00fcten und Extrakte enthalten mehrere verschiedene Cannabinoide, deren Konzentrationen je nach Pflanzensorte und Anbautechnik stark variieren k\u00f6nnen. Die beiden am intensivsten untersuchten Cannabinoide sind Tetrahydrocannabinol (THC) und Cannabidiol (CBD). W\u00e4hrend THC bekanntlich der wichtigste psychoaktive Bestandteil von Cannabis ist, kam der Sachverst\u00e4ndigenausschuss f\u00fcr Drogenabh\u00e4ngigkeit der Weltgesundheitsorganisation in seiner j\u00fcngsten \u00dcberpr\u00fcfung zu dem Schluss, dass CBD „kein Missbrauchspotenzial und kein Potenzial zur Erzeugung von Abh\u00e4ngigkeit“ hat.<\/p>\n

Das Urteil des Europ\u00e4ischen Gerichtshofs geht auf einen Fall zur\u00fcck, der von den franz\u00f6sischen Gerichten vorgelegt wurde. Im Jahr 2017 verurteilte ein franz\u00f6sisches Gericht den Verk\u00e4ufer von E-Zigaretten-Kartuschen, die CBD enthielten, das legal aus der ganzen Hanfpflanze in Tschechien extrahiert worden war, da in Frankreich nur Fasern und Samen als legaler Hanf gelten. Dieser Fall wurde an den Europ\u00e4ischen Gerichtshof verwiesen (Rechtssache C-663\/18), und am 19. November 2020 ver\u00f6ffentlichte das Gericht

\n<\/strong>). Das Gericht erkl\u00e4rte, dass, obwohl Beweise f\u00fcr das Gesundheitsrisiko von CBD noch begrenzt waren, aber vorsorgliche restriktive Ma\u00dfnahmen gerechtfertigt sein k\u00f6nnten, es inkonsistent war, das Marketingverbot nur f\u00fcr CBD aus organischem Anbau und nicht f\u00fcr synthetisches CBD anzuwenden. Bei der Pr\u00fcfung der Rechtm\u00e4\u00dfigkeit dieser Ma\u00dfnahmen, die den freien Warenverkehr innerhalb der EU einschr\u00e4nken, stellte das Gericht au\u00dferdem fest, dass aus Cannabis extrahiertes CBD keine Droge im Sinne des \u00dcbereinkommens von 1961 ist und dass die EU-Verordnungen \u00fcber Industriehanf nicht auf den CBD-Extrakt anwendbar sind, da er kein landwirtschaftliches Erzeugnis im Sinne dieser Verordnungen ist.<\/p>\n

Im Anschluss an diese Entscheidung hat die Europ\u00e4ische Kommission in einem aktuellen Pressebriefing festgestellt, dass Cannabidiol nicht als Droge im Sinne des Einheits\u00fcbereinkommens der Vereinten Nationen \u00fcber Suchtstoffe von 1961 betrachtet werden sollte und Cannabidiol als Lebensmittel eingestuft werden kann, sofern auch die anderen Bedingungen der EU-Verordnung \u00fcber Lebensmittelsicherheit erf\u00fcllt sind.<\/p>\n
